Why gaming is the hardest category to board

Every other vertical on this site is classified high-risk for something measurable — refund rates, delivery windows, ticket sizes, reputational policy. Gaming is different in kind, and it is worth being precise about why.

For a supplement brand, legality is settled: the business is lawful, and underwriting is about how it bills. For a gaming operator, legality is a property of the individual transaction. The same wager placed by the same player on the same platform can be lawful in one state and prohibited across the border. The acquiring bank is therefore not underwriting whether your company is legitimate — it is underwriting whether your controls reliably prevent the transactions that are not.

That is a higher bar, and it explains the experience most operators have: licensed, well-capitalised, professionally run, and still declined repeatedly with no useful explanation. The application was not rejected on the business. It was rejected because the controls were asserted rather than evidenced.

Licensing is question one, and it is not one question

Regulated gaming is licensed state by state. An operator live in four states holds four licences under four regimes, and adding a fifth is a fresh application rather than an expansion.

Underwriting needs to know precisely where you hold authority to operate, where you actually accept play, and how you keep those two lists identical. The gap between them is the entire risk. An operator licensed in four states who accepts play from all fifty is not a licensed operator with a compliance gap — from an acquirer’s seat it is an unlicensed operator with four licences, and it will not be placed.

If you run fantasy sports, skill-based competition or a promotional sweepstakes model, say so explicitly and early. Those are treated differently from wagering in many states, they follow different underwriting paths, and conflating them with betting makes your application harder than it needs to be.

UIGEA, and why your controls are the product

The Unlawful Internet Gambling Enforcement Act places obligations on the payments system itself to identify and block restricted transactions. That is the reason an acquirer’s questions in this vertical go well past the usual financial review: the bank has its own duty here, not merely a commercial preference.

The practical consequence is that your compliance stack is what is being bought. Expect to evidence, in writing:

  • Geolocation. Which vendor, how it is enforced, what happens when a player crosses a state line mid-session, and how VPN and spoofing attempts are handled.
  • Identity and age verification. How players are verified at registration, against what sources, and how you handle a failed check.
  • AML programme. Your monitoring thresholds, escalation path, reporting obligations and the person accountable for them.
  • Responsible gaming. Self-exclusion, deposit limits, and how exclusion lists are honoured across your platforms.
  • Payout mechanics. How winnings leave the platform, and the controls on that path — underwriters care about the outbound side as much as the inbound.

Operators who arrive with this documented get placed. Operators who describe it in a call generally do not, however good the controls actually are.

Merchant category codes and issuer behaviour

MCC 7995 identifies betting and wagering transactions, and it carries real consequences at the issuer end. Many card issuers apply their own rules to it — declining it outright, or treating it as a cash advance with the fees and interest that implies for your player. Your approval rates and your customer experience are both downstream of how you are coded.

That creates an obvious temptation, and it is worth naming plainly: miscoding a gaming business to obtain better approval rates is transaction laundering. It is grounds for immediate termination, network fines and placement on the MATCH list, and it is the fastest way for an operator to become genuinely unbankable. Any processor who offers it as a solution is offering you a much larger problem later.

Chargebacks in gaming

The dominant dispute pattern here is friendly fraud — a player who loses and disputes the deposit, sometimes claiming they did not authorise it, sometimes that they did not know the funds were at stake.

Visa and Mastercard run chargeback monitoring programs with thresholds near 0.9% to 1% of transactions, and gaming operators are among the categories that sit closest to them. What keeps you under the line is evidence rather than argument: logged session and device data, a documented registration and verification trail, clear terms shown at deposit, and a recognisable billing descriptor. Deposit limits and self-exclusion help here too — the player who cannot deposit beyond their means is also the player who does not dispute.
